Sales Terms & License Agreement

These Sales Terms govern all purchases made through ESQUSMI, operated by SAV GmbH.
By purchasing a membership, downloadable image set, or digital magazine from ESQUSMI, you acknowledge and agree to the following terms and conditions:

1. Scope of Sale

ESQUSMI offers access to digital content including memberships, downloadable image sets, and digital magazines (“Products”).
All products are delivered electronically. No physical goods are shipped.

2. No Refund Policy

Due to the digital nature of our products, all sales are final.
Once payment has been processed and access or download is granted, no refunds, exchanges, or cancellations will be issued under any circumstances.

3. License for Personal Use

All purchased content is licensed for personal and private use only.
By purchasing and downloading ESQUSMI content, you agree to the following conditions:

  • The images and digital materials are for private viewing only.

  • You may not copy, share, resell, publish, reproduce, or redistribute the content in any form (digital or print).

  • Commercial, editorial, or public display use — including posting on social media, websites, or any online platform — is strictly prohibited.

  • Use of ESQUSMI content for AI training, datasets, or generative purposes is expressly forbidden.

  • Copyright and all intellectual property rights remain exclusively with the creator and SAV GmbH.

4. Unauthorized Use

Any misuse, reproduction, distribution, or public exposure of ESQUSMI content without prior written authorization constitutes copyright infringement.
Unauthorized use will result in legal action and claims for damages to the fullest extent permitted by law.

5. Membership Access

Membership purchases grant time-limited access to restricted content as described at the time of purchase.
ESQUSMI reserves the right to update, modify, or remove member content at any time without prior notice.

6. Limitation of Liability

To the maximum extent permitted by law, SAV GmbH and its affiliates, directors, employees, and contributors shall not be held liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use ESQUSMI products or services.
This includes, without limitation, damages for loss of data, profits, or goodwill, even if ESQUSMI or SAV GmbH has been advised of the possibility of such damages.
Your use of ESQUSMI content and digital services is at your sole risk.

7. Indemnification

By purchasing, downloading, or accessing ESQUSMI content, you agree to indemnify, defend, and hold harmless SAV GmbH, its affiliates, directors, employees, and licensors from and against any and all claims, liabilities, damages, losses, or expenses — including reasonable legal fees — arising from your violation of these Terms or misuse of any ESQUSMI product or content.

8. Governing Law

These terms are governed by and construed in accordance with the laws applicable to SAV GmbH, without regard to conflict-of-law principles.
Any disputes arising under these terms will be subject to the exclusive jurisdiction of the competent courts in the location of SAV GmbH’s registered office.

By completing a purchase or downloading digital content from ESQUSMI, you confirm that you have read, understood, and accepted these conditions in full.
