Posting Terms

These Posting Terms define the conditions under which artists, photographers, and contributors may submit and publish works on esqusmi, operated by SAV GmbH.
By submitting or allowing publication of content, you agree to these terms in full.

1. General Conditions

esqusmi curates artistic and editorial works for digital publication on its website, online magazine, and associated social media channels.
Submitted materials may include photographs, text, or multimedia content.
All submissions are reviewed and selected at the sole discretion of the editorial team.

Publication on esqusmi does not create any employment or partnership relationship between the contributor and SAV GmbH.
Contributors retain ownership of their work but grant esqusmi a non-exclusive, worldwide license to publish, adapt, crop, and share the material for editorial and promotional use within the context of the platform.

2. Exclusivity

While unpublished and exclusive submissions are preferred, exclusivity is not required.
If the work has been previously published elsewhere, the contributor must indicate where it appeared so proper credit can be given.
Once accepted and published on esqusmi, contributors agree not to submit the same series to another magazine or publication within 30 days of release.

3. Model Releases and Image Rights

All models featured on esqusmi must be of legal age (18+) and have signed a valid model release granting consent for the use and publication of their images.

For all submissions, the photographer or artist bears full responsibility for ensuring that:

  • All persons depicted have provided written consent for publication.

  • The signed model release is included or made available upon request.

  • The name provided for each model (real or artist name) is accurate and authorized for publication.

By submitting to esqusmi, the contributor confirms that all required releases are in place and that no rights of third parties are violated.

4. Usage and Monetization

Published submissions are used solely within esqusmi’s digital ecosystem — including website galleries, the online magazine, and official social media channels to promote featured works.

Submitted works will not be monetized (e.g., sold as sets, prints, or paid content) without a separate written agreement between the artist and SAV GmbH.
Any commercial collaboration will be defined by an individual contract.

5. Credits and Representation

All published works will include contributor and model credits as provided in the submission.
Contributors are responsible for ensuring the accuracy of all information, including team members, social media links, and artist names.
esqusmi reserves the right to adjust formatting, captions, or layouts to align with editorial design and visual coherence.

6. Liability and Legal Responsibility

By submitting or approving publication, the contributor warrants that:

  • They are the lawful copyright owner or have been granted publication rights by the rightful owner.

  • The content does not infringe upon any third-party rights, including trademarks, privacy, or intellectual property.

  • All persons depicted have legally consented to the use of their likeness.

Contributors agree to indemnify and hold harmless SAV GmbH and its affiliates from any claims, losses, or damages arising from the submission or publication of their content.

7. Removal and Editing Rights

esqusmi reserves the right to edit, crop, or remove any submitted work at any time, without notice, if it is deemed inconsistent with the publication’s standards or violates any legal, ethical, or community guideline.
No compensation is owed for removal or editorial modification.

8. Governing Law

These Posting Terms are governed by the laws applicable to SAV GmbH, without regard to conflict-of-law principles.
Any disputes shall be handled by the competent courts at the location of SAV GmbH’s registered office.
